In compliance with national and international regulations governing electronic commerce, our goal is to enable consumers-potentially worldwide-to purchase furniture items online.
WHEREAS.
Customer represents and warrants:
that he/she is of legal age; that the data provided by him/her for the execution of the Contract are correct and true; that, whenever he/she proceeds with a purchase, he/she has read the Privacy Policy, the Cookie Policy, the Shipping and Returns Policy and the General Terms and Conditions of Sale, specified below, and accepts them.
The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of September 6, 2005, on the Consumer Code, with specific reference to the regulations on distance contracts and by Legislative Decree No. 70 of April 9, 2003, on certain aspects concerning electronic commerce.
The following General Terms and Conditions of Sale may be modified by Tendeevolution, without prior notice, also in consideration of any regulatory changes.
Any new General Conditions of Sale will be valid from the date of publication on tendeevolution.it and will be applied to sales concluded after the new disclosure.
The following General Conditions of Sale do not regulate the provision of services or the sale of products by parties other than Tendeevolution that may be present on the site tendeevolution.it through links, banners or other hypertext links.
Orders
The conditions of sale in force are deemed expressly accepted by the Customer at the very moment in which he completes, following the relevant instructions, the order form in electronic format and transmits it electronically to Tendeevolution.
Failure or incorrect provision of data necessarily entails the impossibility of fulfilling the obligations arising from the contract of sale that may be concluded.
The order, only if completed in its entirety and if accepted, will be stored in Tendeevolution's database for the period of time necessary for processing and in any case within the terms of the law.
Since an order form may contain products of different kinds, the delivery times of the individual products that make up the same order may be different, as indicated on the individual products.
For this reason, without prejudice to what is agreed below in the Right of Withdrawal clause, the Customer agrees to accept even a possible delivery at different times, renouncing to claim for any reason compensation and / or indemnity.
Tendeevolution undertakes, in accordance with the law, to promptly inform the Customer of the possible unavailability of the product ordered and jointly, without prejudice to what is agreed below in the Right of Withdrawal clause, also undertakes to propose to the Customer reasonable alternative solutions.
Tendeevolution will send the Customer, by e-mail, for all products purchased, an order summary (ORDER DETAILS).
The Order Summary will contain information about the products purchased, including, unit and total price, means of payment and expected transportation costs.
Prices
The prices shown for each item offered for sale by Tendeevolution on the site are in Euros and are to the public including VAT and packaging, excluding shipping costs. Tendeevolution reserves the right to change the prices shown on the pages of its site without notice.
In the case of price list increases occurred after the acquisition of orders not yet processed, Tendeevolution will still apply the prices in place on the site at the time of the order.
Payments
All orders are considered to have been acquired upon completion of payment.
Payments are always inclusive of shipping charges.
Tendeevolution accepts payment by PAYPAL ACCOUNT, by CREDIT CARDS (VISA, MASTERCARD, VISA ELECTRON, MAESTRO, V-PAY, AMERICAN EXPRESS, JCB, UPI) on secure circuit, and by Bank Transfer in Advance.
In case of payment made by BANK TRANSFER IN ADVANCE, to be made in favor of Tendeevolution. - Iban: IT65A08952819500000006509 indicating in the reason for the order number and holder, the evasion of the goods will be made only after the administrative confirmation of payment. After 10 days from the order if the ADVANCE BANK TRANSFER has not yet been made the order is automatically canceled.
In the case of payment by CREDIT CARD, the financial information (for example, the number of the credit/debit card or the date of its expiration) will be forwarded, via encrypted protocol, to the secure circuits and Paypal that provide the relevant remote electronic payment services, without third parties being able, in any way, to have access to it.
Such information, moreover, will never be known to Tendeevolution.
In the event that refund operations procured by the return of products as a result of exercising the right of withdrawal, Tendeevolution will put in place through the banking circuits agreed, the procedures necessary for the successful completion of the refund.
Tendeevolution will issue all tax documents together with the delivered goods.
Deliveries and shipping costs
Italy
Attention: Upon delivery of the products, the Customer is required to check:
* that the number of packages corresponds to the transport document
* that the packaging is intact, undamaged, and with seals of closure intact
Any damage to the packaging and / or the product, or the mismatch in the number of packages, must be immediately detected, affixing a specific reason for return / not taking charge on the delivery document of the product to be returned to the courier.
Once the package has been opened, any problems inherent in the physical integrity of the items ordered must be reported to Tendeevolution Customer Service via email to info@tendeevolution.it or by phone at 3345026558.
Delivery time: within 48/72 working hours, delivery c/o ground floor c/o address specified in the order.
Complaints and returns
Tendeevolution company is willing to acknowledge any type of problem found upon receipt of goods (defective items or items not meeting expectations)
Methods of use
Tendeevolution disclaims any responsibility in case of Improper use of the products placed on sale. Tendeevolution can not be held liable for any damages, direct or indirect, suffered by the customer for the incorrect or improper use of the product.
Right of Withdrawal
According to Article 52 of D- Lgs. 005, as amended by D. Lgs 1/2014, the Customer may withdraw from the purchase contract for any reason within 14 (fourteen) total days from the date of receipt of the products.
Exceptions are, according to Article 59 of the Consumer Code, the "supply of goods made to measure or clearly personalized."
The right of withdrawal will be fully taken over by the Company if the product has quality discrepancies or manufacturing defects.
NOTE: If the return is requested for other reasons, the Customer must resend the products at OWN EXPENSE to Tendeevolution within 14 (fourteen) days of receipt of the goods, Customer Service will notify the Customer of the destination address for the returned goods.
WARNING: The goods must be returned intact, complete with all its parts, and in the original packaging, without any signs of wear or dirt or incorrect and improper use of the product, during the period of possession of the same by the Customer, in full compliance with the conditions below:
Privacy
The Personal Data collected with the submission of the Order will be processed by Tendeevolution for the sole purpose of satisfying the expressed requests of the Customer, in accordance with Legislative Decree 196/2003 and the privacy policy on the site.
Copyright
Trademarks, logos and other distinctive signs on the site belong to their respective owners. Therefore, the use of trademarks, logos and other distinctive signs including reproduction on other websites by unauthorized third parties is PROHIBITED. The contents of the site are protected by copyright (text, images and graphics).
